These Terms govern your use of the CartHound abandoned-cart recovery app (the “App”). By installing or using the App, you (the “Merchant”) agree to these Terms.

The App is provided by PE Hrin Tamara, Ostafia Dashkevycha street, 22, Kyiv, 02139, Ukraine (“we”, “us”).

The service

The App detects abandoned carts in your Shopify store and sends reminder emails and/or SMS to shoppers, with a link to complete their purchase and optional discount codes. It attributes recovered orders and reports on performance.

Merchant responsibilities

• You are responsible for obtaining and maintaining valid marketing consent from your shoppers (via Shopify checkout) before messages are sent, and for complying with all applicable laws, including TCPA (US), CAN-SPAM (US), GDPR/UK GDPR (EU/UK), and local marketing and privacy rules.
• You must provide accurate store and contact information.
• You must not use the App to send unlawful, deceptive, or unsolicited messages, or content prohibited by carriers (e.g. illegal goods, hate, fraud).

We provide tools to respect consent (we only send SMS to shoppers with SMS marketing consent, and honour STOP/unsubscribe), but compliance for your store remains your responsibility as the sender.

Fees

The App is free to install. We charge a percentage of the revenue the App generates for your store — a recovered abandoned cart, a sale from a popup discount code, or a sale from a campaign we sent — and a paid plan lowers that percentage. SMS is charged at cost. Fees are billed through Shopify. Current pricing is shown in the App.

Acceptable use & suspension

We may suspend or terminate access for abuse, spam complaints, high bounce/opt-out rates, non-payment, or violation of these Terms or carrier/Shopify policies.

Disclaimers & liability

The App is provided “as is”, without warranties. To the maximum extent permitted by law, we are not liable for indirect or consequential damages, and our total liability is limited to the fees you paid us in the 3 months before the claim.

Termination

You may stop using the App at any time by uninstalling it. These Terms end when the App is uninstalled.

Data processing

When we process personal data of your customers to provide the App, we do so as your processor under the Data Processing Agreement, which forms part of these Terms and is accepted together with them.

Governing law

These Terms are governed by the laws of Ukraine, unless otherwise required by mandatory local law.
